Understanding the New Labor Code Amendments for 2024
◷ Oct 24, 2023
◉ Atty. Roberto Valencia, Senior Partner
The Philippine labor landscape is undergoing a significant transformation. As the 2024 fiscal year approaches, legislative amendments to the Labor Code aim to modernize the relationship between employers and the remote workforce, reflecting global shifts in professional dynamics.
The Expansion of Remote Work Protections
Building upon the foundations of Republic Act No. 11165, otherwise known as the Telecommuting Act, the 2024 amendments provide more granular definitions regarding occupational safety and health standards (OSHS) for home-based employees. The primary focus remains the parity of rights between those working within traditional office spaces and those operating remotely.
“The amendment clarifies that the ‘workplace’ is no longer a physical address owned by the employer, but any space where the employee performs their contractual duties with the employer’s consent.”
— Section 4, Republic Act No. 12014 (Proposed)Revised Compensation for Overtime
A critical shift in the 2024 amendments involves the calculation of overtime for 'Field Personnel'. Historically, employees whose actual hours of work in the field could not be determined with reasonable certainty were excluded from overtime pay benefits. The new directive mandates digital logging systems as a standard for establishing work hours.
• Mandatory 13th-month pay adjustments based on night shift differential inclusions.
• Enhanced paternity leave benefits increasing from 7 to 14 days for married employees.
• New protocols for Constructive Dismissal claims in the context of forced Return-To-Office (RTO) mandates.
